Agricultural Law PACA Trust Protection My payment terms are 35 days; I have been told that these terms make me ineligible for PACA trust protection. Is this true? Yes. The times for prompt accounting and prompt payment are stated in the USDA regulations. If the parties to a transaction elect to use different times for payment, it cannot exceed 30 days after receipt and acceptance of the produce and still qualify for coverage under the trust. |
